1. This Notice and Takedown Policy applies to all users of http://everlasting.uk.com (the “Website”) and are supplemental to our Terms and Conditions of Website use, Privacy Policy and our Terms and Conditions of Purchase.

2. The Website is designed for the sharing of memories of deceased friends, relatives, colleagues, team mates, favourite celebrities, sports heroes and musicians on web pages known as “Tribute Pages”. The Website is operated by EVERLASTING (UK) Limited a company registered in England (Company No. 06909733) and our registered office is at Second Floor, Galley House, Moon Lane, Barnet, Hertfordshire EN5 5YL (“us” “we”).

3. Contributions to the Tribute Pages are not moderated by us. We will not be responsible as author, editor or publisher of any contribution submitted to a Tribute Page and we expressly exclude our liability for any loss or damage arising from the use of the Tribute Pages by any person in contravention of this Notice and Takedown Policy and our Terms and Conditions.

4. If we have any reason to believe or are given notice that any contribution submitted to the Website is in breach of our content standards listed at condition 9 of our Terms and Conditions, we shall, without notice to you, withdraw the contribution from the Website and we reserve the right to bar You from being a Contributor or Administrator of the Tribute Page to which the contribution relates of any other Tribute Page of which you are either a Contributor or Administrator. Further, we expressly exclude our liability to you for removing any contribution you make to the Website.

5. When you submit a contribution for inclusion on a Tribute Page, whether or not it accepted for inclusion is at the sole discretion of the Tribute Creator. We have no liability to you if a Tribute Creator chooses not to accept your contribution for inclusion.

6. The use of Tribute Pages by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use and contribute to the Tribute Pages that it is important that they communicate with their children about their safety online. Minors who are using the Tribute Pages should be made aware of the potential risks to them and of their obligation to comply with this Notice and Takedown Policy and the Terms and Conditions of Website use.

7. If you wish to complain about any contribution posted on a Tribute Page, please contact us at report@everlasting.uk.com. We will then review the contribution and decide whether it complies with our content standards at clause 9 of our Terms and Conditions. We will deal with any contribution which, in our opinion, violates our content standards. We will inform you of the outcome of our review within a reasonable time of receiving your complaint. Please precisely identify the content about which you are notifying us, including the Tribute Page upon which it is posted. You should also provide us with details of your complaint, and if you are alleging copyright infringement, evidence that you own the copyright.
